How to Enter and Selection of Winners: To enter, fully complete and submit the entry form (available at www.michele.com) including your name, age, address and email address. Sweepstakes drawing will be held on or around December 22, 2008. To be eligible for the drawing, entries must be received by 11:59 PM CT on December 21, 2008. One winner will be randomly selected from among all eligible entries received. Selected winner need not be present to win.
Prize: One Michele Newport Tote Handbag in patchwork (style number MHB1030998) (approximate retail value $995). One prize will be awarded on the drawing date. By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the judges which shall be final and binding in all respects. The winner will be notified by email and asked to verify his/her name and complete mailing address. The winner may be required to sign an Affidavit of Eligibility and submit tax and other related documentation as a condition to the delivery of the prize. If a winner does not provide the requested information within ten (10) business days of the date of attempted winner notification, the prize may be forfeited and awarded to an alternate entrant. An undeliverable or unclaimed prize will not be awarded to the selected winner. A forfeited prize may not be awarded.
General Conditions: Once submitted, entries become the exclusive property of Michele and will not be acknowledged or returned. Odds of winning depend upon the total number of entries received. All entries are subject to verification prior to awarding a prize. Limit one entry per person. Michele reserves the right to disqualify multiple entries. If, in Michele's opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if technical or other difficulties compromise the integrity of the Sweepstakes, Michele reserves the right to terminate the Sweepstakes and conduct a random drawing to award the prize from among all eligible entries received as of the termination date, or to select a winner in such manner as deemed fair and appropriate by Michele. In case of dispute as to identity of a winner who entered online, entry will be declared made by the registered user of the e-mail account.
By participating, entrants release and agree to hold harmless Michele and each of its parent companies, subsidiaries and affiliates, and each of their respective directors, officers, employees, representatives and agents from any liability whatsoever for any injuries, losses or damages of any kind resulting from acceptance, possession or use/misuse of any prize or participation in the Sweepstakes.
No prize transfer or cash substitutes allowed except at Michele’s sole discretion due to prize unavailability for any reason and only then for a prize of equal or greater retail value. Taxes on the prize are solely the responsibility of the winner.
Michele is not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or other technical failures, unauthorized human intervention, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause. Once submitted, entries become the exclusive property of Michele and will not be acknowledged or returned. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Entry material/data that has been tampered with or altered is void. Michele reserves the right, at its sole discretion, to cancel/suspend/modify the Sweepstakes if it becomes corrupted in any manner such that it cannot be conducted as originally planned and, in such event, to select winners by random drawing from all eligible online entries received prior to and/or after (if appropriate) the action taken by Michele. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT BE MADE, MICHELE RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
Unless prohibited by applicable law, entry constitutes permission to use an entrant's name, photograph, likeness, voice and/or, address (city and state) in all media, in perpetuity, in any manner Michele deems appropriate for publicity purposes without any further compensation to such entrant. By entering or accepting a prize in the Sweepstakes, winner agrees to be bound by these Official Rules and to conform to all federal, state and local laws and regulations. When applicable, the winner (or, if the winner is a minor, the winner's parent or legal guardian) will be required to execute and return to Michele within ten (10) business days an Affidavit of Eligibility and a Liability and Publicity Release and such tax or other documentation as requested by Michele to be eligible for the prize or an alternate winner will be selected. Winner may be required to furnish proof of identity, address and birth date in order to receive prize.
Eligibility: Subject to all applicable federal and state laws and regulations. Open to all legal residents of the 50 United States and the District of Columbia, 18 years of age or older at the time of entry except that employees of Michele and its parent companies, divisions, affiliates, and subsidiaries and their immediate family members (spouses, parents, siblings, children and each of their respective spouses) and those residing in the same household, are not eligible. Void where prohibited by law.
